Carl Schmitt argues that the role of myth plays an essential role in politics and that nationalism, in any confrontation, will win over socialism. Schmitt’s argument can be used to justify the events that occurred in Germany during the late 20s and early 30s. However, even though nationalism did play a key role in post-hyperinflation Germany, it is far too simplistic to say that the only motive of such events was nationalism. Events like the Beer hall putsch or the growth and success of the Nazi party were not solely because of nationalism. There were other factors that contributed to these events such as the fact that Germany was in a terrible situation to begin with. Germany was in chaos after WW1, and when the Great Depression followed, unemployment, inflation and food shortage increased even more. Such events led to the growth of the Nazi party as Germans felt like Hitler represented what many of them felt-- hatred of the republic. The Nazi party rose significatively becau se of their usage of propaganda, their anti-Semitism, their violence, their hatred of the Weimar republic and also because of opportunism. During the days of colonialism where India was lucky to be a British Colony, Bombay was a major port of entry for people travelling to India and onwards to South East Asia and Australia. Due to this huge influx in commercial trade, the areas around the port developed extremely quickly as an area of industry and shipping related services such as import/export, cargo handling and packing. All of this went a long way to the urbanisation of Bombay, drawing in more farming people when they learned of the prospects available to them. Following the British withdrawal in 1947, this upwards ‘boom’ only increased. Nowadays, it is a huge problem for city planners and developers. The site of the city is hugely restricted resulting in the eventual creation onto the mainland in the form of a â€Å"greater metropolitan area†. These new sites, onto which the city has expanded, are becoming very overcrowded even 100 years ago. Today, the density is just under 60,000 people per square mile. Due to popular demand, the price of inner city land has risen astronomically, a feature of all developing cities. As a result, rather incongruously, the land prices in Bombay are among the highest in the world. This just adds to the overcrowding of the slums, as people are forced to live there as they are unable to afford anything in the city where property costs in the region of US$3180 per sq. t. this, coupled with the short supply of housing, results in an accelerated growth of shanty towns, another case example being the farvelas on the outskirts of many (expansive) Brazilian cities such as Sio Paulo and Rio de Janeiro. It is an inescapable upwards escalation into greater levels of poverty, as new migrants to the city locate themselves on the edges of the slums, furthest away from the centre of the city, where the jobs are located and are often built on dangerous land (old mines, near railways, on river marshland etc. and very few have land rights, so there are just squatters with no legal protection. This is a major environmental issue and also poses significant problems to the inhabitants’ health, in a country where the death rate is already 7. 9/1000 (as of July 2009) and where the average life expectancy is just 60. Levels of sanitation in the slum areas, such as Dharavi are often of a substandard level. Sewage removal and treatment is minimal and in most areas, non-existent. Running clean water is also scarce, leaving children and babies without adequate levels of hygiene, needed to grow healthily. Electricity connections are also very sparse, so people have to make do with more primitive methods, often far more dangerous than modern methods, such as cooking for example. All of these issues have major social consequences, as the people become ‘trapped’ in a permanent state of poverty, unable to better their lives, but remain as it is perceived to have a better standard of living than in the rural areas. In Dharavi itself, the Indian local governments in Bombay and the Maharashtra state are planning a large-scale redevelopment of Dharavi. They plan to clear away areas of the slum housing section by section, replacing the little 1 or 2 storey shacks with 7 floor tenement blocks. Families who can prove they have lived in Dharavi since at least 1995 will; receive free new housing, and everyone will receive temporary accommodation for the duration of the massive redevelopment programme. The remainder of the new housing will be sold cheaply (or rented) on the open and free market that India enjoys with its relatively stable political and economic situation. This however, though it would improve the situation for over 600,000 people rather drastically, it will create a lot of significant conflicts between residents and developers, and may be seen by some as a bit too ‘idealistic’, just like Mandela’s promise to black South Africans for better housing. The reality is, that these things take time to materialise, if they ever do. The project will not even go ahead unless a majority of the [registered] residents of Dharavi agree to do so. This means that those residents who are not officially registered as residents of Dharavi (a large number of migrant squatters), will not have their opinions counted in any capacity. It is also widely feared that such a development would not yield economic benefits for the developers, and so, much needed residential accommodation for the [ex] residents of Dharavi, will be used for commercial and office space to serve the ever expanding business sector – defeating the whole initial development objective. In conclusion, from the evidence laid out, it is clear that Bombay is suffering heavily as a result of mass urbanisation, and has done throughout its history, spanning back to even before the colonial days of the Raj. Projects such as the expansion of the Bandra Kurla complex threaten the condition of the poorer people, often illegally squatting on land, and are planned to solely benefit the banking and business/commerce sector. Migration from the countryside rural areas adding the issue of urbanisation are increasing the population at a large rate. Alongside this, poor planning and mismanagement from the authorities, failing to address the genuine needs of the city, all result in a city with gigantic disparity, overcrowding in slums and an ‘all encasing’ state of impoverishment for the vast majority of the population of the city. However, the healthy conflict does not extend into the realm of unethical behavior in order to achieve desired outcomes. Authors concluded that leadership and management could be same thing for small organizations. However, the large organizations should have different connotations for management and leadership. (Nijstad, Berger-Selman De Dreu, 2014) discussed how some leaders may be hesitant to discipline or terminate employees whereas managers are usually administrators that understand the bottom line while work to meet organizational goals. The differences seem to be emotionally connected to help people get the job done versus non-emotionally connected to meet goals and expectations. A challenge that can face a leader is allowing the progression of the project under the direct supervision of the director or manager even though there may be times of failure or the level of progress does not meet expectations. In the article, authors provided a nursing example to differentiate between managers and leaders. According to authors, when employees are lead with motivation and role modeling, employees come back meeting their expected goals. After the initial discussion, authors argued the reason to practice the leadership and servant leadership in particular. Authors highlighted that the next logical step in the path of management should be leadership. It is expected that a leader would be a good manager. Authors highlighted that leader has capabilities that are beyond then the capabilities of managers. If a leader views people merely as a means to an end, and utilizes aspects of servant leadership simply because they believe it will gain them some personal advantage by causing people to work harder to achieve a goal, then the basis of the theory itself is being undermined. The contemporary organizations require more leaders than managers as the focus is on transformation of organizations and not on transactional work. Authors, further extended this argument that situational leadership style should suits well the organizations in contemporary environment. For the situational leader, servant leadership may be viewed as a tactic or a tool, but they need to tread lightly, as mistaking servant leadership for a means of manipulation could be a very detrimental error. Authors concluded that there are significant differences between leadership and management. The role of leaders is more of transformational in nature and role of managers is more of transactional in nature. Van Dierendonck, Stam, Boersma, Windt Alkema (2014) highlighted that leadership places emphasis on the needs of others. For example, leaders will tend to empathize, developing potential, nurturing, and so forth. The problem is, todays word is less ethical, and have fewer regards for religious components plus the needs of the collective will prioritize over individuals. Additionally, todays culture chooses not or not having the time to accommodate the needs of individuals, its a shame but there is a light at the end of the tunnel. On that note, there are more firms using such leadership style than ever before even though the numbers are small but growing. Authors discussed various difference between leaders and managers. Authors highlighted that leaders are generally more supportive than managers. A true leader is one who is always approachable and people can discuss anything with leader without any hesitation. However, the relationship between a manager and a subordinate is more for mal and transactional in nature. In most of the cases, manager would be the one who will daily interact with employees for small works. Authors agreed with the perspective that a leader should always motivate the employees. There are times when leaders are not directly involved with the employees. However, the motivation can be done through speeches, video conferencing meetings, etc. Authors also presented that there could be cases when the managers are power hungry. However, a leader is someone who has natural power. They do not seek or need power, and only want what is best for the people. Good leaders are able to do this and still ensure that the goals of an organization are met by their influence over others. Authors concluded that organizations should realize the difference between management and leadership. It is correct that organizations would need the support of both leaders and managers. However, leaders must have the capability to manage the managers. It is important that an integrated eco-system should be created where all the leaders, managers and employees can work together. Edwards, Schedlitzki, Turnbull Gill (2015) argued that servant leadership style is the old but contemporary style of leadership. The way servant leadership differ from traditional forms of leadership is when a servant leader possesses the calling of a servant first, wanting and willing to serve others first. In the book Servant Leadership, Greenleaf talks about how Leo was a leader and the difference in being a servant and a leader and how they can work together. Leadership was bestowed upon a person who was by nature a servant. It was something given, or assumed, that could be taken away. His servant nature was the real man, not bestowed, not assumed, and not to be taken away. The servant leaders have a better understanding of managers and it appears that the managers who can attain the pat h of servant leaders would be good and effective leaders in the organization. Authors concluded that organization needs both managers and leaders for successful working. The leaders may want to establish the vision and decide the high-level goals. However, it is the role of managers to get the things done and ensure that all the employees are on same page. Friendships are great, networking is invaluable, but when a leader is working unethically, it is paramount that friendships and acquaintances be set aside for the good of the company. Since leaders set the tone for the ethics of the organization, to allow them to be have detrimentally to the overall organization, will ultimately lead to their followers acting the same way. Experience teaches that some lower level employees wait for the opportunity to blame their leaders and use that leaders behavior as an excuse to behave the same way. Author states that if at any time the leadership within any organization acts in was that are unethical, the board must act as a governing body that takes corrective action to improve the behavior of that leader or remove that individual. The reason being is that the board of directors must always see to serve the needs of all stakeholders, both internal and external. The leaders are more outcome oriented and managers are more process oriented. It is important that managers should also have a vision shared by leaders. Cartilaginous Fish - Chondrichthyes - Profile Cartilaginous fishes (Chondrichthyes) are a group of vertebrates that includes sharks, rays, skates and chimaeras. Members of this group include the largest and most formidable marine predators alive today such as the great white shark and the tiger shark as well as large filter feeders such as the manta ray, whale shark and basking shark. Cartilaginous fishes have a skeleton that consists  of cartilage (in contrast to their cousins the bony fish, whose skeletons are made up of true bone). Cartilage is both tough and flexible and it  provides sufficient  structural support to enable cartilaginous fishes to grow to considerable size. The largest living cartilaginous fish is the  whale shark  (about 30 feet long and 10 tons). The largest known cartilaginous fish ever to have lived is  Megalodon  (about 70 feet long and 50-100 tons). Other large cartilaginous fish include the manta ray (about 30 feet long) and the basking shark (about 40 feet long and 19 tons). Small cartilaginous fishes include the short-nose electric ray (about 4 inches long and weighs 1 pound), the starry skate (about 30 inches long), the pale catshark (about 8 inches long) and the dwarf lantern shark (about 7 inches long). Cartilaginous fishes is that they have jaws, paired fins, paired nostrils and a two-chambered heart. They also  have tough skin that is covered with small  tooth-like scales called denticles. Denticles are similar to teeth in many ways. The core of a denticle consists of a  pulp cavity that receives blood flow for nourishment. The pulp cavity is capped with a cone-shaped layer of dentine. The denticle sits on top of a basal plate which overlies the dermis. Each denticle is covered with an enamel-like substance. Most cartilaginous fishes live in marine habitats all their lives, but a few species of sharks and rays live in freshwater during all or part of their lives. Cartilaginous fishes are carnivorous and most species feed on live prey. There are some species that feed on the remains of dead animals and still others that are filter feeders. Cartilaginous fishes first appear in the fossil record about 420 million years ago during the Devonian Period.  The earliest known cartilaginous fishes were ancient sharks that were descended from bony-skeleton placoderms. These primitive sharks are older than the dinosaurs. They swam in the world’s oceans 420 million years ago, 200 million years before the first dinosaurs appeared on land. Fossil evidence for sharks is plentiful but consists mostly of tiny remnants of the former fish- teeth, scales, fin spines, bits of calcified vertebra, fragments of cranium. Extensive skeletal remains of sharks are missing- cartilage does not fossilize like true bone. By piecing together the shark remains that do exist, scientists have uncovered a diverse and deep ancestry. Sharks of the past include ancient creatures such as Cladoselache and Ctenacanths. These early sharks were followed by Stethacanthus and Falcatus, creatures that lived during the Carboniferous Period, in a window of time referred to as the â€Å"Golden Age of Sharks†, when shark diversity blossomed to include 45 families. During the Jurassic Period, there was Hybodus, Mcmurdodus, Paleospinax and eventually the Neoselachians. The Jurassic Period also saw the emergence of the first batoids: the skates and rays. Later came the filter feeding sharks and rays, the hammerhead sharks, and the lamnoid sharks (great white shark, megamouth shark, basking shark, sandtiger, and others). The World Health Organisation (2009) defines palliative care as supporting patients and their families with physical, psychological, social and spiritual aspects of care during a physically and emotionally difficult journey of living with a non-curative condition. People’s awareness of palliative care has been linked to the rise of the modern hospice movement back in 1967, when a doctor by the name of Dame Cicely Saunders was responsible for opening a hospice in London called St Christopher’s. Cicely voiced concerns about the way death was dealt with in hospitals around this time and focused her attention on approaching death of cancer patients with more dignity and humanity (Kearney and Richardson 2006). Cicely went on to write several articles for nursing journals and her work was thought to be key to the development of the role of the clinical specialist palliative care nurse (Payne 2008). In the 1970’s the first Macmillan nurses were introduced. Macmillan nurses were generally employed by the National Health Service owever their posts were funded by Macmillan cancer support. The charitable service provider offered local health authorities the opportunity to enrol on a programme that would fund a Macmillan nursing post for a period of 3 years. Once the 3 year period ceased the health authority would become solely responsible for continuing the service out of their budgets (Lugton and Mcintyre 2005). Primarily the role of the Macmillan nurse back in the 1970â€⠄¢s was to provide direct hands-on care for patients whose illness had progressed to the terminal stage as well as support for their families. The role of the Macmillan nurses today tends to focus on meeting the specialist palliative care needs of patients. They provide support with how to manage difficult symptoms associated with the illness and various pain control methods as well as advice on numerous other things, as opposed to the general palliative care in the form of hands on nursing care. This type of palliative care is provided by generalist nurses within the community, such as district and community nurses. Their caseload not only consists of patients requiring palliative care but patients with various other nursing needs. Not all specialist palliative care nurses have the title Macmillan nurse, only those whose post were initially funded by Macmillan Cancer Support and then the NHS. Macmillan nurses are registered nurses who have at least 5 years experience in nursing. In addition they have experience in cancer or palliative care and further to their general nurse training have completed specialist courses, which enable them to have the title specialist nurse (Macmillan Cancer Support 2010). The work carried out by both Macmillan nurses and clinical specialist palliative care nurses differ only slightly, regardless of where they work (Cambridge University Hospitals NHS 2007). According to Seymour et al (2002) the role of the Macmillan nurse has evolved to that of the clinical nurse specialist. A clinical nurse specialist was defined by The Royal College of Nursing in 1988 as having gained through further training an advanced expertise and knowledge in a particular branch of nursing care. They further clarified the role as having responsibility for clinical practice, education, management and having knowledge of relevant research on their specialist area of nursing (Newbury et al 2008). Palliative care patient’s medical needs can change rapidly and may require the expertise of specialist palliative care nurses. Unlike generalist nurses, specialist palliative care nurse’s sole priorities lie with patients with palliative care needs. Referrals to specialist nurses are made when the needs of palliative care patients are becoming more complex and their symptoms harder to manage (Buckley 2008). However a review carried out by Ahmed (2004) suggests that there is lack of understanding of when and to whom referrals should be made to making them inconsistent. This lack of knowledge could be a barrier to the specialist palliative care nurses success. Another view could be that generalist nurses have been providing palliative care for many years, so why should they feel they need to hand over the care of the patients? The Royal College of Nursing (2002) outlined essential skills that were thought to be necessary to the role of specialist palliative care nurses. These were effective communication and the ability to deal with people’s grief, loss and bereavement. Lugton and Mcintyre (2005) suggest that communication is the key attribute to the role of the specialist palliative care nurse however Penson (2000) argues that comfort is the key attribute. Community specialist palliative care nurses are just one group of professionals that make up the multi-disciplinary team providing patients with palliative care. Their work involves close contact and communication with patient’s general practitioners, district and community nurses as well as community matrons. Community matrons are a relatively new role development. They were introduced in 2006 and the role was thought to be developed as a result of the population of the United Kingdom living longer and living with long term conditions. Their work involves looking at the patient holistically and supporting them whilst addressing the complex needs associated with their long term condition. (Sines et al 2009). Supporting patients to manage their symptoms and aiding them to live independently was one of the main proposals set out in the National Service Framework for long term conditions (Department of Health 2005). Prior to the introduction of community specialist palliative care nurses palliative care for the past 150 years or more was provided by district and community nurses in the home environment (Pellett 2009). According to Meehan (2010) within the United Kingdom numbers of qualified district nurses working in the community has fallen dramatically. This questions whether the introduction of the specialist nurses such as community specialist palliative care nurses and community matrons has contributed to these numbers falling. With shortages of district nurses patients care will be impacted upon. Terminally ill patients who have agreed their preferred place of care may have this taken away if problems arise in their condition and they eventually end up having to be admitted to the hospital or hospice unnecessarily (National Audit Office 2008). This in turn will have an impact on the current trends at the heart of the government’s priorities which following the NHS next stage review looked at increasing areas of healthcare into the community and reducing hospital admissions in an attempt to cut NHS costs (Darzi 2008). When the government announced their financial cuts to the NHS back in 2007 specialist nurse posts came under attack. Specialist services as opposed to generalist services are expensive and specialist nurses are in a higher pay band making them more vulnerable to losing their positions in spending cuts (Dean 2010). This questions the government’s views on specialist nurses. Are they seen as additional extras that could cut back in future spending cuts, in turn having an effect on patient care? Although the role of the specialist palliative care nurse is not a recent development to community nursing their role has changed over the last five years. This is in response to the needs of the population and government priorities. Demographic changes are a feature that have impacted on the work of the community specialist palliative care nurse. According to Sines et al (2009) the United Kingdom’s population is set to increase by 7. 2% by the year 2016. The central reasons for this increase are due to the fact that individuals are living longer and migration. Gomes and Higginson (2008) suggest that by the year 2030, 22% of the United Kingdom and Wales will be aged 65 years and over, with two thirds of people being over 75 years old when they die. Older age inevitably increases the certainty that people are more likely to suffer from non communicable diseases as well as cancers and the presence of co-morbidities (Payne 2008). The needs of the aging population will mean that community specialist palliative care nurses will be called upon to deal with increasing demand on palliative care services. As well as the population of the United Kingdom increasing so has patient’s expectations of the NHS, health and social care due to the input from the media. The introduction of the white paper: Our Health, Our care, Our say: a new direction for community services (2006) set out by the Department of Health was thought to be responsible for these expectations. People up and down the country were asked what they liked and wanted from their local health and social care services. People responded with enthusiasm and the government listened and promised to give the public more choices, providing better information about their health and how to stay healthy. The paper gave people more power and influence over the type and recommended standard of service they were to be offered locally. People expect to be treated more as partners and equals and expect choices and options available to them (Department of Health 2006). The provision of palliative care has also changed, historically provision of palliative care focused on supporting patients with cancer however over the last few years moves have taken place to expand the scope of specialist palliative care in order to attend to needs of patients with non-malignant diseases (Small et al 2000). In 1997 the department of health released a white paper: The New NHS: Modern and Dependable which suggested that the Calman-Hine Report: A policy Framework for Commissioning Cancer Services (1995), which examined and proposed a restructuring to cancer services in the United Kingdom could extend its services even further to include people with non-malignant diseases (Department of Health 1997). Amongst the Calman-Hine report were recommendations that everyone with cancer should have equal access to high levels of expertise regardless of where they reside in the country, and a distinction between palliative and terminal care meaning that patients have access to services earlier on in their illness (Calman Hine 1995). Expanding specialist palliative care to patients with non-malignant diseases has had a significant impact on the work load of specialist palliative care services by stretching resources to the limit. Although emphasis has been on providing all patients with life limiting diseases palliative care, is this actually being done? According to Watson et al (2005) specialist palliative care services are not readily available to patients with non-malignant diseases as they are to cancer patients. There is also a lack of support for patients from the voluntary services such as Marie Curie. In order to assist nurses to deliver evidence based practise initiatives such as care pathways were developed. These developments were put in place following the introduction of the white paper: A First Class Service-Quality in the new NHS back in 1998. The white paper was proposed by the government and aimed at producing a strategy to improve the delivery of health care. Three national initiatives which are important parts to the palliative care approach are the Gold Standard Framework, Preferred Place of Care document and the Liverpool Care Pathway. The Gold Standard Framework is a programme of assessment and care. Its aims are to improve quality of life for both patients and their families in the last year of a patient’s life. The Liverpool Care Pathway was developed 10 years ago and is a tool to assist health care professionals care for those who are in their last few days of living. The third initiative preferred place of care document is aimed at putting the patient at the centre of care, giving patients the choice regarding where they would like to be cared for and where they choose to die (Ellershaw Wilkinson 2003). The preferred place of care document is important to the changing role of the community specialist palliative care nurse. The End of Life Strategy for England delivered by the Department of Health (2008) set out a comprehensive plan to improve end of life care for all dying people. This is the first strategy that does not solely concentrate on improving end of life care for people with cancer. Following on from the government’s proposals in 2003 one of the key components of the strategy is giving people the choice about where they choose to die. Given the choice many people would prefer to die in their own homes with adequate support from professionals, however this is not always possible (Thomas 2004). At the beginning of the 20th century the majority of people who were terminally ill died in their own homes whereas today statistics show that 66% of people die in hospitals and 19% at home (Ellershaw Wilkinson 2003). Some of the reasons why this is not possible are due to inadequate symptom control, which is an important role of the community specialist palliative care nurses. Community specialist palliative care nurses generally work normal working hours so what provision is there for patients outside of these hours and who covers the work of the nurses when their working day is complete? Palliative patient’s complex needs require swift responses from palliative specialists when it comes to out of hours services. If patients were receiving 24 hour care unnecessary emergency hospital admissions and suffering of patients would be reduced. A number of community specialist palliative care nurses within certain trusts have gone onto complete nurse prescribing courses. They have the ability to prescribe from the extended formulary making them independent prescribers. For specialist nurses’ having this expanded nursing skill means they have the opportunity to work more autonomously. As one of the key roles of the community specialist palliative care nurse is managing difficult symptoms having the ability to prescribe immediately and appropriately helps promote a service that will reduce patients and carers distress (Mula and Ware 2003). This further acknowledges the importance of specialist nurses working out of normal working hours. The National Institute for Clinical Excellence (2004) suggests that in order to provide good end of life care patients need to have access to specialist palliative care 24 hours a day, 7 days a week. However a report by the National Audit office (2008) reported that just over half of local health authorities provided such care. The last government promised that all cancer patients would have access to specialist nurses trained in their condition (Rose 2010) however generally this too is only available during normal working hours according to Macmillan Cancer Support (2010) meaning that it is then acceptable for such care to be provided by generalist nurses.

The United States is said to be one of the richest countries in the world, yet our teachers are being paid one of the lowest amounts. The Education Intelligence Agency, author of the article â€Å"Ohio Teacher Overcomes Union’s Tolerance† published an International Teacher Salary Report ranking the fifty states by â€Å"how much the average salary exceeded per capita personal income.† According to the Education Intelligence Agency Ohio’s percentage rate is only fifty- five point one percent. According to the Education Intelligence Agency the lowest state percentage is in South Dakota at twenty- three point six percent and the highest state percentage is Alaska at one hundred and one point five percent. Teachers are a very important part of our society. Teachers’ jobs consist of more than just sitting behind a desk for nine months and having paid summers off. The re are many extra tasks that teachers have that most people don not consider. Teachers in public schools work hard for a low salary and should be more appreciated; public school teachers shape the world’s young people, serve as role models, and work long hours.   Ã‚  Ã‚  Ã‚  Ã‚  Ruth E. Sternberg is the reporter for the Columbus [Ohio] Dispatch Schools and has completed a survey on the issue of Ohio’s teacher’s salaries. According to Sternberg, the public high schools that have high salaries do not have enough money for new technologies. This is a disadvantage for the students. The students do not have the advantage of computers, digital cameras, and other new technologies that make learning more fun. The students who do not have these technologies may lose interest in learning. Sternberg also points out that higher salaries also causes businesses to decide not to open their stores in that district because of the higher taxes. The stores do not want to pay out more money than what they have to, even if it is for a good cause. I can understand the concern of the business owners, but they should think about where the money goes and how much it would benefit the public schools in that area. Sternberg discusses the loss of teachers that would be forced on the district if they raised the average teacher salary. An emphasis is placed on understanding diverse family types. You will be expected to learn basic concepts related to families, to understand specific developmental issues of both individuals and families, and to gain a level of tolerance for different perspectives. You may find your own service opportunity or ask for help at the MSU Center for Service Learning and Civic Engagement in the Student Services Building. Legal Framework

The Law of a particular state is the body of rules designed to regulate human conduct within that state. This can be defined clearly as an organized system of principles and rules designed to control and influence the conduct of individuals and groups. The aim of most legal systems, officially at least, is to provide a means of influenced by the major forces that shaped the society in which they operate. Consequently there are three types of rule:Rules, which forbid certain types of behavior under threat of penalty. Rules, which require people to compensate others whom they injure in certain ways. Rules, which specify what must be done in order certain types of human activity, example: to form a company, to marry, or to make a will. Although it is inevitable that the courts will make some rules, Parliament is the sovereign body. It can therefore impose new rules or abolish any existing rules. The basic role of the courts is to interpret these rules, decide whether they have been Rose n and pass sentence or make an award of compensation.Law and Morality The law, which is enforced by the courts, must be distinguished from what is sometimes referred to as ‘natural' or ‘moral' law. In many cases the rules of law and morality clearly coincide. Example: If a person murders another, this offends both law and morality. The state will therefore punish the offender. Sometimes, however, the rules of law and morality are not the same. Example: Homosexual behavior in private between consenting adults is not illegal although some people might regard it as a breach of moral law.The term ‘natural law is sometimes used to refer to rules, which although not enacted are accepted as part of the legal system. Example: The right of both sides to be heard (or to remain silent), and the principle that an accused person is innocent until proven guilty. Law and Justice The basic aim of law is the attainment of Justice in society. However, in some situations the degree o f Justice hoped for is not achieved. Example 1 : Compensation for injuries usually depends on proving that someone else s at fault.If a person is injured due to his own fault, or in a ‘pure' accident where no one is at fault, he will not receive compensation unless he is insured. This inequality Example 2: The rules regarding mistake and misrepresentation in the formation of a contract often operate to determine which of two innocent parties must bear all of the loss. The loss is not divided equality, case to be referred LEWIS v AVERY (1971). Example 3: Sentencing policies applied by magistrates in different areas often result n substantially different sentences for very similar offences.Conclusion It would therefore be an oversimplification to say that most people obey the law because it is Just, or because it coincides with their view of which is morally correct. Law is also closely related to force and authority and these relationships would have to be examined in order to properly explain the intrinsic nature of law, and to find out why most people obey the law.
